These Terms and Conditions (“Terms”) govern access to and use of the EyeCheckup platform (“Platform”), operated by EyeCheckup (“Company”, “we”, “us”, or “our”).

By accessing or using the Platform, you agree to these Terms. If you do not agree, you must not use the Platform.


1. Intended Use

EyeCheckup provides artificial intelligence–based analysis of retinal fundus images and Optical Coherence Tomography (OCT) scans to support healthcare professionals.

  • The Platform is intended solely for use by qualified healthcare professionals or authorized institutions
  • It is designed as a clinical decision support tool, not a standalone diagnostic system (unless explicitly approved by relevant regulatory authorities—this depends on your regulatory status, which you should verify)
  • It must not be used for self-diagnosis or by patients directly

2. No Medical Advice

The Platform does not provide medical advice.

  • Outputs generated by EyeCheckup are informational and supportive only
  • Final diagnosis and treatment decisions remain the responsibility of a licensed healthcare professional
  • You should not rely solely on the Platform without clinical evaluation

3. User Responsibilities

Users agree to:

  • Use the Platform in compliance with applicable laws and regulations
  • Ensure they are authorized to upload and process patient data
  • Obtain all necessary patient consents where required
  • Verify outputs before making clinical decisions
  • Maintain the confidentiality of access credentials

Users must not:

  • Upload data they are not authorized to use
  • Attempt to reverse-engineer or misuse the Platform
  • Use the Platform for unlawful or non-medical purposes

4. Data Protection and Privacy

Use of the Platform is subject to our Privacy Policy.

  • Users are responsible for ensuring lawful data collection and sharing
  • EyeCheckup processes data as a data processor, unless otherwise agreed
  • Data should be anonymized or pseudonymized where possible

I am not fully certain how your deployments are structured (e.g., cloud vs hospital servers), so you may want to explicitly define data flows in your final version.


5. Regulatory Status

EyeCheckup may be classified as a medical device software depending on jurisdiction.

  • Availability and permitted use may vary by country
  • Users are responsible for ensuring compliance with local regulatory requirements
  • Features and claims may differ depending on regulatory approvals

If you do not yet have FDA/CE approval for certain features, it is important not to imply otherwise.


6. Accuracy and Limitations

While EyeCheckup is developed using clinically validated methods:

  • No system is 100% accurate
  • Performance may vary based on image quality, device type, and clinical conditions
  • The Platform may not detect all diseases or conditions

You may want to insert your validated performance metrics here, but only if they are fully verified and published.


7. Intellectual Property

All rights, including:

  • Software
  • Algorithms
  • Models
  • Documentation

remain the exclusive property of EyeCheckup or its licensors.

Users are granted a limited, non-transferable, non-exclusive license to use the Platform in accordance with these Terms.


8. Service Availability

We aim to provide reliable access, but:

  • The Platform may experience interruptions or downtime
  • Maintenance, updates, or external factors may affect availability
  • We do not guarantee uninterrupted or error-free operation

9. Limitation of Liability

To the maximum extent permitted by law:

  • EyeCheckup shall not be liable for indirect, incidental, or consequential damages
  • Liability related to clinical decisions remains with the healthcare provider
  • The Platform is provided “as is” and “as available”

Some jurisdictions may limit the enforceability of these clauses, so legal review is important.


10. Indemnification

Users agree to indemnify and hold harmless EyeCheckup from claims arising from:

  • Misuse of the Platform
  • Violation of these Terms
  • Failure to comply with applicable laws or medical standards

11. Termination

We reserve the right to:

  • Suspend or terminate access in case of misuse or breach
  • Modify or discontinue the Platform (with reasonable notice where possible)

12. Changes to Terms

We may update these Terms from time to time.

  • Updates will be posted on this page
  • Continued use constitutes acceptance of the updated Terms

13. Governing Law

These Terms shall be governed by the laws of: Republic of Türkiye
